These Terms govern access to imaarat.com and orders, quotations and services confirmed through the website or official Imaarat communication channels. By using the website or accepting an order confirmation, quotation or invoice, you agree to these Terms together with the Privacy Policy and Return and Refund Policy.
1. Website Operator and Business Model
Imaarat provides access to construction materials, home-improvement products and selected project-based services. Depending on the listing or transaction, Imaarat may be the seller, may source goods from a supplier, or may facilitate a transaction with a third-party seller or installation partner. The responsible seller or contracting party should be identified on the quotation, invoice or order confirmation. Imaarat’s full legal entity name and complete address must be displayed before these Terms are published.
2. Eligibility and Customer Information
· You must have legal capacity to place an order. Business customers confirm that the person placing an order is authorized to act for the business.
· You must provide accurate contact, billing, delivery, site-access and project information and promptly correct any error.
· You are responsible for keeping account credentials secure and for activity carried out through your account unless you promptly report unauthorized use.
3. Product Information and Technical Suitability
· We aim to provide accurate descriptions, images, dimensions, specifications and availability, but errors or supplier changes may occur.
· Images are illustrative. Colour, grain, pattern, texture and finish may vary because of screen settings, natural variation or production batches.
· The customer is responsible for confirming suitability, dimensions, compatibility, quantity and compliance with drawings or engineering requirements before ordering. Website content and online estimates are not a substitute for advice from a qualified architect, engineer or other professional.
· No claim regarding authorization, certification, performance or warranty should be relied upon unless it appears in the product documentation, quotation or written confirmation.
4. Prices, Quotations, Taxes and Availability
· Website prices may change without notice before an order is accepted. Bulk materials and imported or supplier-priced goods may change more frequently.
· Unless stated otherwise, delivery, unloading, installation, taxes, duties, testing, civil works and site-preparation costs are excluded.
· A quotation is valid only for the period stated in it and may be conditional on quantity, stock, exchange rate, supplier confirmation, site survey or advance payment.
· A cart submission, quote request or automated acknowledgement is not acceptance of an order. An order is accepted when Imaarat issues a written confirmation or invoice and any required payment is verified.
· If a material pricing or product-information error is identified before dispatch, Imaarat may correct the information and ask the customer to reconfirm, or cancel and refund the affected order.
5. Payment
· Payment must be made through a method displayed at checkout or stated on an official quotation or invoice.
· Bulk, custom, imported and project-based orders may require advance and milestone payments. The applicable schedule is the one stated in the accepted quotation or contract.
· The customer must not send card PINs, one-time passwords or online-banking passwords to Imaarat personnel.
· Imaarat may withhold dispatch, procurement or installation until cleared funds and any required documents are received.
6. Delivery, Risk and Site Access
· Delivery dates are estimates unless expressly guaranteed in writing. Delays may occur because of supplier availability, transport, weather, government restrictions, access limitations or other events outside reasonable control.
· The customer must provide safe and lawful site access for the agreed vehicle, unloading process or installation team and must disclose no-entry rules, road limitations, working-hour restrictions and security requirements before dispatch.
· Where delivery fails because the information or access provided by the customer is incorrect or inadequate, reasonable waiting, re-delivery, storage or transport charges may apply.
· Risk in goods normally passes when delivery is completed and acknowledged, subject to claims for shortage, visible damage, incorrect supply, hidden defect and any rights that cannot lawfully be excluded. Ownership may remain with the seller until full payment where stated in the quotation or invoice.
7. Installation and Project-Based Services
· Elevators, HVAC, fire-fighting systems, custom kitchens, fabricated doors and similar work may require a site survey, approved drawings, technical submittals, civil-work readiness and a separate contract or quotation.
· Scope, exclusions, programme, payment milestones, testing, commissioning, handover, warranty and maintenance obligations are governed by the accepted project documents.
· The customer is responsible for approvals, utilities, civil works, safe access and coordination by others unless the accepted scope assigns those obligations to Imaarat or its contractor.
· Variations or additional work require written approval and may affect price and completion time.
8. Inspection, Returns and Warranties
Customers should inspect deliveries promptly and follow the Return and Refund Policy. Product and installation warranties apply only as stated in the relevant warranty card, product page, quotation, invoice or contract. Nothing in these Terms removes rights or remedies that cannot lawfully be excluded.
9. Acceptable Use
· Do not misuse the website, attempt unauthorized access, introduce malicious code, interfere with security or use false identity or payment information.
· Do not copy, scrape or commercially reuse catalogue content, images, prices or data except with written permission or as permitted by law.
· Reviews, questions and other submissions must be truthful, lawful and must not infringe another person’s rights.
10. Intellectual Property
Website content, branding, text, graphics, layouts and original images are owned by Imaarat or used under licence. Manufacturer names and trademarks belong to their respective owners. No licence is granted except the limited right to use the website for lawful personal or business purchasing purposes.
11. Third-Party Services and Links
The website may use or link to payment, delivery, social-media, mapping, manufacturer and other third-party services. Those services may have separate terms and policies. Imaarat is not responsible for third-party content or systems outside its reasonable control, but this does not remove responsibilities Imaarat has as a seller or contracting party.
12. Limitation of Liability
· To the extent permitted by law, Imaarat is not liable for indirect or consequential loss, loss of profit, delay caused by events outside reasonable control, or loss arising from customer-supplied measurements, drawings, specifications, storage or site conditions.
· For a valid claim relating to an order, Imaarat’s aggregate contractual liability will generally not exceed the amount paid for the affected goods or service, except where a higher remedy is required by law or expressly agreed in a project contract.
· Nothing in these Terms limits liability for fraud, wilful misconduct, personal injury caused by negligence, or any statutory right or liability that cannot legally be limited.
13. Force Majeure
Neither party is responsible for delay or failure caused by events beyond reasonable control, including severe weather, natural disaster, fire, strike, transport interruption, government action, import restriction, public emergency, utility failure or supplier shutdown. The affected party should notify the other party and take reasonable steps to reduce the impact. Payment remains due for goods or work already properly supplied unless otherwise agreed.
14. Complaints and Disputes
Please contact Imaarat first with the order number and details of the complaint so the matter can be reviewed. The parties should attempt in good faith to resolve the issue through written communication or a meeting. These Terms are governed by the laws of Pakistan. Subject to any mandatory consumer forum or jurisdiction, disputes will be submitted to the courts of competent jurisdiction in Lahore, Punjab.
15. Changes, Severability and No Waiver
· Imaarat may update these Terms for future website use or orders. The version accepted with an existing order will continue to govern that order unless the parties agree otherwise.
· If a provision is held invalid or unenforceable, the remaining provisions continue in effect to the extent permitted by law.
· A delay in enforcing a right does not waive that right.
